These terms and conditions outline the rules and regulations for the use of SereneU’s website, Located at sereneu.com.au / sereneu.com.

By accessing this website you indicate that you read, understand and accept these terms and conditions and agree to abide them at all times. Do not continue to use sereneu.com.au/ sereneu.com if you do not agree to take all the terms and conditions stated on this page. 

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company's terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Intellectual property:

All content published and made available on our site is the property of SereneU. This includes, but is not limited to images, texts, logos, documents, downloadable files and anything that contributes to the composition of our site

Acceptable use:

As a user of our site, you agree to use our site legally, not to use our site for illegal purpose, and not to:

· Harres or misuse other users of our site

· Violate the rights of other users of our site 

· Violate the intellectual property sites of the site owner or any third party to the site 

· Hack into the account of another user of the site 

· Acting anyway that could be considered fraudulent; Or 

Transmit computer virus that could affect other users 

If you believe you are using out site illegally or in a manner that violates these terms and conditions, we reserve the right t limit , suspend or terminate your access to our site. We also reserve the right to take any legal steps necessary to prevent you from accessing our site.

Accounts 

When you create an account on our site, you agree to the following:

· You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to the account

· All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes. 

We reserve the right to suspend or terminate your account if you are using our site illegally or if you violate these terms and conditions. 

Sales of Services

These terms and conditions govern the sale of services available on our site. The following services are available on our site;

Strategic Psychotherapy.

Clinical Hypnotherapy, and 

Hypno- Counselling. 

The services will be paid in full when the service appoinments are booked. 

These terms and conditions applied to all the services that are displayed on our website at the time you access it.

All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our site at your own risk. 

We reserve the right to modify, reject or cancel your booking whenever it becomes necessary. If we cancel your booking and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third party Goods and Services 

Our site may offer services from third parties. We cannot guarantee the quality or accuracy of services made available by third parties on our site. 

Free Sessions:

We may offer 20 mins Pre consultation before the initial appointment to assess suitability.

At the end of your free session ,After assessing the suitability and scope for treatments, clints can book their initial and follow up appointments via online booking portal on our website to proceed with the therapy. 

To cancel your free consult, minimum of 48hr cancellation notice is required. 

Payments 

We accept the following payment methods on our site;

Debit cards

When you provide us with your payment information, you authorize us to use of and access to the payment instrument you have chosen to use, and the data may be stored for future payments. 

By providing us with your payment information you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these terms and conditions, we reserve the right to cancel or reverse your transaction.

Refunds

We provide refund for service sold on our site as follows. 

Appointment cancellation, Rescheduling and Refund policy :

1. Your time slot is dedicated to you therefore, please be on time to utilise the full session.

2. A full payment is required at the time of booking or before the service/ session. 

3. Cancellations or reschedules can be made up to 48 hrs prior to the scheduled appointment time. Cancellations / Reschedules made within 48 - 24hrs prior to your appointment will be eligible for a 50% refund.

4. Cancellations / Reschedules made within 24 hrs prior to your scheduled appointment, or non-attendance will be charged in full.

5. Maximum of two consecutive cancellations or reschedules can be made within the guidelines mentioned above. Changes made after that will revoke a refund.

6. Same guidelines will be applicable to Telehealth and Zoom sessions and NDIS clients.

7. Private Health Rebate may be applied however the therapist will not be able to receive any reimbursement from any insurance provider. Therefore, Clients are fully responsible for the payment of all fees. Eligibility for an Insurance Rebate is solely dependent on your health policy and clients are responsible to bill their own insurance if they believe they have appropriate cover. Please contact your provider to find out more.

Consumer Protection Law

Where the Australian consumer Law, Schedule 2 of the competition and consumer act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, These terms and conditions will not limit your legal rights and remedies under the legislation.

These terms and conditions will be read subject to the mandatory provisions of that legislations. If there is a conflict between these terms and conditions and that legislation, the mandatory provision of the legislation will apply. 

Limitation of Liability

SereneU / Therapists or the owner of the business will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the site. 

Except where prohibited by law, by using this site, you indemnify and hold harmless SereneU / Therapist from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our site or your violation of these terms and conditions. 

Applicable Law

These terms and conditions are governed by the laws of the State of South Australia.

Additional Terms

Therapy Disclaimer

I understand that;

1. My therapy at SereneU is not going to replace any of my medications.

2. My therapist does not diagnose any condition or prescribe any medications.

3. My therapist cannot make me do or not do anything in the therapy sessions and only there to guide me connect with my own resources.

4. The depth, effectiveness and the results of any therapy/ Therapeutic intervention is different from person to person hence cannot guarantee a result.

5. I give my full consent to receive therapy and to proceed with the treatments.

6. I agree to be fully committed and involved in the treatments / therapy / process and homework etc. 

7. The improvement or the result I get is directly correlated with the effort I put in towards it.

8. I am always truthful when providing background information requested by my therapist as it can change the treatment plan as well as the effectiveness / outcome of my therapy.

9. I can terminate therapy session at any time or when the therapist believe I have return to the full functionality. 

10. Suspension, termination, shall be discussed between therapist and client in the case of a pattern of behaviour that reveals disinterest or lack of commitment to therapy, Or, for any unresolved conflict or impasse between therapist and client.

11. If my presenting situation or State of my mental health is outside the scope of my therapist, I will be advised accordingly. And suggestions / referrals will be made to contact a suitable healthcare professional for further treatment.

12. The scope of therapy and all relevant information has been provided to me.

13. The same guidelines will be applicable to Zoom and Telehealth sessions.

14. Same guidelines will be applicable to NDIS clients.

Privacy and Confidentiality

I understand that;

The information related to my therapy sessions will be kept confidential between me and my therapist / SerentU except in the following circumstances.

· When the client signed a written request or provide a consent for the therapist to release information to another party

· Therapist has a reason to suspect the client expresses serious intent to harm him/her self or others.

· Therapist has a reason to suspect an abuse of a minor, an elderly person (Sixty-five years or older) or a dependant adult.

· In case of a subpoena / court order to disclose of information. 

· Therapist has evidence or reasonable suspicion that client is involved in a major crime.

· When seeking supervision / Support (No identifiers will be used)

Same level of confidentiality will be maintained when working with Minors under the age of eighteen. Also, a Written consent is needed from parents / Guardians to proceed with therapy / treatment.

Severability 

If at any time any of the provisions set forth in these terms and conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these terms and conditions. 

All other provisions will not be affected by the removal and the rest of these terms and conditions will still be considered valid.

Changes 

These terms and conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our site and the way we expect users to behave on our site. We will notify users by email of changes to these terms and conditions or post a notice on our site.
